TERMS AND CONDITIONS FOR PARTICIPATION IN THE LOYALTY PROGRAM OF “PHILLY VIBE” AD

 

  1. Subject Matter of the Rules

1.1. These rules (the “Rules”) establish the terms and conditions for the conduct of the loyalty program with rewards (the “Loyalty Program”) and govern the relationship between the Organizer and the individuals participating in the Loyalty Program.

  1. Organizer

2.1. The Organizer of the Loyalty Program is “PHILLY VIBE” JSC, a company registered with the Commercial Register and the Register of Non-Profit Legal Entities at the Registry Agency under UIC 203418843, with its seat and registered office at: Sofia, Tsarigradsko Shose Blvd. No. 115z, “The Mall” Shopping Center, Level 2 (the “Organizer”).

  1. Participant Requirements

3.1. The Loyalty Program is open to individuals who are at least 18 years of age and have registered in the Organizer’s mobile application – PizzaLab Family (the “Mobile Application”). The Mobile Application can be downloaded free of charge from the App Store and Google Play. By registering in the Mobile Application, participants declare that they are familiar with the terms of this Loyalty Program, as well as the Organizer’s General Terms and Conditions and Privacy Policy.

3.2. After registering in the Mobile Application, participants may increase the amount accumulated by them not only through orders placed in the Mobile Application, but also through orders made by calling 0700 42888, by providing the telephone number used for their registration in the Mobile Application, as well as on-site at BAO BAR and Pizza Lab locations, by presenting to a staff member their individual QR code, available in the Mobile Application under the “SEE MORE” section.

3.3. The information contained in the created user profile is confidential and must not be shared with third parties. In case a participant in the Loyalty Program loses access to their user profile, they must contact the Customer Service Department at phone number 0700 42888, which is shared among Pizza Lab and BAO BAR. The participant must provide their full name and the email address used to register in the Mobile Application, as well as explain the circumstances that led to the loss of access. The Organizer reserves the right, at its sole discretion, to refuse the restoration of points accumulated in the participant’s user profile.

3.4. Points earned in the Loyalty Program pursuant to Article 4.2 below are non-transferable to third parties.

3.5. The products won by participants in the Loyalty Program, pursuant to Article 4.2 below, are strictly for personal use. Participants may not engage in commercial activities with any of the products obtained through the Loyalty Program.

  1. Purpose of the Loyalty Program and Rewards

4.1. The Organizer's Loyalty Program is designed to offer various types of discounts or to provide certain products free of charge to loyal customers, while also informing them about new products and services available through the Mobile Application. The Loyalty Program applies to the Organizer’s various restaurant brands: Pizza Lab and BAO BAR.

4.2. With each order placed through the Mobile Application that includes at least one selected product, participants in the Loyalty Program accumulate points based on the amount spent. The Loyalty Program consists of six separate tiers of proportional value, each corresponding to the amount spent by the participants.

Rewards for orders from Pizza Lab:

Upon spending BGN 29,34 / EUR 15 – a complimentary drink of choice (applies to non-alcoholic beverages only);

Upon spending BGN 58,67  / EUR 30 – a complimentary cookie of choice;

Upon spending BGN 97,79 / EUR 50 – BGN 5 / EUR 2.56 discount;

Upon spending BGN 136,91  / EUR 70 – a Choco Pizza of choice;

Upon spending BGN 176,02  / EUR 90 – a 25 cm pizza of choice;

Upon spending BGN 234,70 / EUR 120 – a 30 cm pizza of choice;

Upon spending BGN 293,37 / EUR 150 – a 36 cm pizza of choice.

 

Rewards for Orders from BAO BAR:

Upon spending BGN 29,34 / EUR 15 – a drink of choice (applies to non-alcoholic beverages only);

Upon spending BGN 58,67  / EUR 30 – fries of choice;

Upon spending BGN 97,79 / EUR 50 – Bao Donuts of choice;

Upon spending BGN 136,91 / EUR 70 – a corndog of choice;

Upon spending BGN 176,02 / EUR 90 – a bao of choice;

Upon spending BGN 234,70 / EUR 120 – a rice bowl of choice;

  1. Redemption of Rewards

5.1. Upon reaching each level, in accordance with the rules set out in Article 4.2 above, the Organizer shall notify the participant via the Mobile Application. Prizes may be collected by participants in person at one of the locations listed in detail at: https://pizzalab.bg/, https://baobar.bg/, by identifying themselves with their name and the code received, or upon placing a subsequent order in accordance with one of the methods set out in Article 3.2 above.

5.2. Each code constitutes a digital voucher valid for a period of 30 days, after which it expires automatically. The validity period of the digital voucher is calculated from the date of the most recent order through which one of the six levels, as detailed in Article 4.2 above, was reached.

5.3. In the event that a participant reaches the final level of the Loyalty Program (a total expenditure of BGN 300/ EUR 153,39) within a period of twelve months, the Loyalty Program shall automatically restart from the beginning.

5.4. In the event that the participant does not reach the final level of the Loyalty Program, the program shall be cancelled and automatically restarted, with all points accumulated up to that moment being forfeited. In such cases, participants in the Loyalty Program do not lose their right to redeem any prizes already earned, in accordance with the 30-day period provided for in Article 5.2.

5.5. The twelve-month period referred to in Articles 5.3 and 5.4 shall commence on the date of the first order placed in accordance with one of the methods set out in Article 3.2 above. under the rules of the Program.

5.6. Upon receipt of the rewards under Article 4.2, in the manners provided for in Article 5.1, the following rules shall apply:

a. Rewards in the form of a voucher of a specific value or a percentage discount may not be combined with an order containing one or more promotional combo menus. Should participants in the Loyalty Program wish to combine them, the discount shall be applied to the full price of the products included in the combo menu, without taking into account any initially applied promotional discount therein.

b. Rewards in the form of a free item may be combined with an order containing one or more promotional combo menus. If a reward in the form of a voucher of a specific value or a percentage discount is also added to the order in addition to the free item, the discount shall be applied to the full price of the products in the combo menu, without taking into account any initially applied promotional discount therein.

c. Rewards in the form of a specific amount or percentage reduction from the total order value may not be combined with each other when ordering one or more promotional combo menus.

  1. Non-Transferability of User Profile and Points

6.1. The registered profile and levels reached within the Loyalty Program cannot be transferred, shared with third parties, or combined with other profiles to progress through the levels more quickly. The Organizer monitors the number of registered profiles and, if a participant registers more than one profile under the same name, the Organizer may remove duplicate registrations, refuse to process an order, or deny the granting of a reward.

  1. Amendments and Termination of the Loyalty Program

7.1. The Organizer is entitled to unilaterally suspend or terminate the Loyalty Program at any time and for any duration it deems necessary. In such cases, participants in the Loyalty Program do not lose the opportunity to redeem the rewards already earned up to that point, in accordance with the 30-day validity period specified in Article 5.2.

7.2. In case of changes to the terms and conditions of the Loyalty Program, such changes will be published in the Mobile Application and on the following websites:

  1. Final Provisions

8.1. The Organizer declares that it has taken all necessary technical and organizational measures to ensure the proper functioning of the Mobile Application that enables participation in the Loyalty Program. However, technical issues may still arise. The Organizer undertakes to resolve any such technical issues as quickly as possible.

8.2. In the event of a dispute or any other issue related to the Loyalty Program, participants should contact the Organizer at one of the following email addresses:

8.3. If the dispute cannot be resolved amicably, it may be referred to the competent Bulgarian court.

8.4. Notwithstanding the above, participants may submit their complaints to Alternative Dispute Resolution (ADR) bodies. ADR bodies handle disputes between consumers and traders related to obligations arising from concluded contracts for the sale of goods or provision of services, including online contracts. ADR is an alternative method of resolving consumer disputes aimed at saving time and costs and preserving the relationship between the parties.

8.5. For matters not regulated by these Loyalty Program Rules, the applicable provisions of Bulgarian law shall apply.
